1. Introduction and Acceptance of Terms

These Terms and Conditions (hereinafter referred to as "Terms", "Agreement", or "Terms of Service") constitute a legally binding agreement between you (hereinafter referred to as "User", "Player", "Member", or "you") and ph433.cam (hereinafter referred to as "ph433", "we", "us", or "our"), a PAGCOR-licensed online gaming operator registered and operating within the Republic of the Philippines.

If you do not agree with any provision contained in these Terms, you must immediately discontinue all use of ph433 Services and refrain from creating an account or engaging in any gaming activities on our Platform. Continued use of ph433 Services following the posting of changes to these Terms will constitute your acceptance of such modifications.

2. Eligibility Requirements and Account Registration

2.1 Age and Legal Capacity

To register for and use ph433 Services, you must meet all of the following eligibility criteria without exception:

• You must be at least twenty-one (21) years of age at the time of account registration, in accordance with Republic Act No. 9487 and PAGCOR regulations governing legal gambling age in the Philippines.
• You must possess full legal capacity to enter into binding contracts under Philippine law, meaning you are not under any legal disability, guardianship, or conservatorship that would impair your ability to understand and comply with these Terms.
• You must be physically located within the territorial jurisdiction of the Republic of the Philippines at the time of account registration and during all gaming sessions, as ph433 Services are exclusively licensed for Philippine residents and citizens.
• You must not be listed on any self-exclusion registry maintained by PAGCOR, ph433, or any other Philippine gaming operator, nor be subject to any voluntary or involuntary gambling exclusion orders.
• You must not be employed by ph433, any affiliated entity, game provider, payment processor, or regulatory body in a capacity that creates conflicts of interest or violates applicable regulations.

2.2 Account Registration Process

Registration for a ph433 account requires submission of accurate, current, and complete information including but not limited to your full legal name as it appears on government-issued identification, date of birth, residential address within the Philippines, valid email address, mobile phone number registered with a Philippine telecommunications provider, and such other information as ph433 may reasonably require to comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations.

You agree to maintain the accuracy of all registration information throughout the duration of your account relationship with ph433 and to promptly update any information that becomes outdated or inaccurate. Failure to maintain current information may result in suspension of account privileges, delays in withdrawal processing, or account termination.

2.3 Account Restrictions and Prohibitions

Each individual may maintain only one (1) account with ph433. The creation or use of multiple accounts by a single individual, whether simultaneously or sequentially, is strictly prohibited and constitutes grounds for immediate account termination, forfeiture of account balances, cancellation of bonuses, and potential referral to law enforcement authorities. ph433 employs sophisticated fraud detection systems to identify duplicate accounts through analysis of personal information, payment methods, device fingerprints, IP addresses, and behavioral patterns.

3. Deposits, Withdrawals, and Financial Transactions

3.1 Deposit Methods and Processing

ph433 accepts deposits through various payment methods approved for Philippine online gaming transactions, including but not limited to GCash, Maya (formerly PayMaya), direct bank transfers from BPI, BDO, Metrobank, UnionBank and other accredited Philippine financial institutions, over-the-counter deposits at 7-Eleven and other authorized retail partners, and cryptocurrency transfers via USDT and other approved digital assets. All deposits must originate from accounts or payment instruments registered in your own name and under your direct control.

Minimum and maximum deposit limits vary by payment method and are clearly displayed during the deposit process. ph433 reserves the right to modify deposit limits, impose additional restrictions, or suspend deposit privileges for accounts exhibiting suspicious activity, violation of these Terms, or as required by regulatory directives. Deposits are typically credited to your ph433 account balance instantaneously for digital payment methods or within the timeframes specified for each payment channel.

3.2 Withdrawal Procedures and Requirements

Withdrawal requests are subject to identity verification, account standing review, and compliance with applicable wagering requirements. ph433 processes withdrawals within forty-eight (48) hours of request submission, excluding weekends and Philippine public holidays, though actual receipt of funds depends on the processing times of your chosen payment method and financial institution. Withdrawals can only be made to accounts or payment instruments verified as belonging to you and previously used for deposits to your ph433 account.

Before your first withdrawal, ph433 requires completion of Know Your Customer (KYC) verification including submission of valid government-issued photo identification (Philippine passport, driver's license, UMID, postal ID, or other PAGCOR-accepted documents), proof of residential address (utility bill, bank statement, or government correspondence issued within the past three months), and verification of payment method ownership. Additional documentation may be requested for transactions exceeding certain thresholds or where fraud prevention protocols require enhanced due diligence.

3.3 Anti-Money Laundering Compliance

All deposits must be wagered at least one (1) time at minimum odds before withdrawal eligibility is established. Game outcomes are determined solely by algorithmic randomness and cannot be predicted, influenced, or manipulated by players, ph433 staff, or any third party. Players agree to engage in gaming activities solely for personal entertainment purposes and not for professional gambling, money laundering, fraud, or any illegal purpose. 4.1 Prohibited Gaming Activities

• Collusion with other players to manipulate game outcomes, share cards or game information, or coordinate betting patterns in multiplayer games
• Exploitation of software vulnerabilities, bugs, or errors to gain unfair advantage or generate unauthorized wins
• Use of vpn, proxy servers, or location spoofing technology to circumvent geographic restrictions or mask true location
• Bonus abuse including creating multiple accounts to claim welcome bonuses, coordinated betting to clear wagering requirements with minimal risk, or any systematic exploitation of promotional offers
• Reverse engineering, decompiling, or attempting to analyze ph433 software, game algorithms, or security systems
• Arbitrage betting, syndicate play, or professional gambling operations conducted through ph433 accounts

4.2 Game Malfunctions and Disputes

In the event of game malfunction, software error, or communication failure that affects game outcomes or account balances, ph433 reserves the right to void affected bets, correct account balances, and restore accounts to their pre-error state. All game malfunctions void pays and plays. If you believe a game malfunction has occurred, you must immediately cease playing and contact ph433 customer support with detailed information including game name, date, time, bet amount, and description of the alleged malfunction. Failure to report malfunctions promptly may limit ph433's ability to investigate and provide remedies.

5. Bonuses, Promotions, and Wagering Requirements

ph433 offers various bonuses, promotions, tournaments, and loyalty programs (collectively "Promotions") subject to specific terms and conditions outlined in each Promotion's details. Unless explicitly stated otherwise, all Promotions are subject to wagering requirements, game restrictions, maximum bet limits, expiration dates, and other conditions that must be satisfied before bonus funds or winnings can be withdrawn.

Participation in ph433 Promotions is voluntary and requires explicit opt-in for most offers. By claiming any bonus or participating in any Promotion, you agree to be bound by the specific terms governing that offer in addition to these general Terms. Bonus funds are provided for gaming purposes only and cannot be withdrawn until wagering requirements are fully satisfied. Wagering requirements typically range from twenty (20x) to forty (40x) times the bonus amount and must be completed within the specified timeframe, usually between seven (7) to thirty (30) days from bonus credit.

5.1 Bonus Abuse and Forfeiture

ph433 employs sophisticated fraud detection systems to identify bonus abuse patterns including but not limited to creation of multiple accounts to claim welcome bonuses repeatedly, coordinated betting between accounts to minimize risk while clearing wagering requirements, abuse of errors in bonus calculation or credit, and any other systematic exploitation of Promotions. Detected bonus abuse results in immediate cancellation of bonuses, forfeiture of associated winnings, account suspension or termination, and potential legal action.

ph433 reserves the right to withhold, cancel, or claw back bonuses and associated winnings at any time if it determines in its sole discretion that Terms have been violated, gameplay has been irregular or suspicious, or the integrity of the Promotion has been compromised. This includes situations where technical errors result in incorrect bonus amounts being credited. Players acknowledge that they have no entitlement to bonuses beyond what is explicitly granted under Promotion terms and that ph433's determination of bonus abuse or Terms violations is final and binding.

6. Responsible Gaming and Player Protection

ph433 is committed to promoting responsible gaming practices and protecting players from the potential harms associated with excessive or problem gambling. In compliance with PAGCOR responsible gaming guidelines, ph433 provides comprehensive tools and resources to help players maintain control over their gaming activities and recognize warning signs of problem gambling behavior.

All players have access to deposit limits, loss limits, session time limits, cooling-off periods, and self-exclusion options through their account settings. These tools allow you to set maximum amounts you can deposit or lose within specified timeframes (daily, weekly, or monthly), establish session duration alerts, take temporary breaks from gaming, or permanently close your account if you determine that gambling is having negative impacts on your life.

• Deposit Limits: Set maximum deposit amounts per day, week, or month. Once set, limits can be decreased immediately but increases require a cooling-off period of forty-eight (48) hours.

All content, software, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, games, and other materials contained within ph433 Services (collectively "ph433 Content") are owned by, licensed to, or controlled by ph433 and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use ph433 Services solely for personal, non-commercial gaming purposes in accordance with these Terms. This license does not include any right to: (a) resell, redistribute, or provide commercial access to ph433 Services; (b) modify, copy, reproduce, download, store, transmit, or create derivative works from ph433 Content except as necessary for personal use; (c) frame or embed ph433 Services on other websites; (d) reverse engineer, decompile, or disassemble any software or technology underlying ph433 Services; or (e) use automated systems or software to extract data from ph433 Services for any purpose.

8. Privacy and Data Protection

ph433's collection, use, storage, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using ph433 Services, you consent to the collection and use of your personal information as described in the Privacy Policy and acknowledge that ph433 may share information with payment processors, game providers, regulatory authorities, and other third parties as necessary to provide Services and comply with legal obligations.

In compliance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), ph433 implements appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, you acknowledge that no method of internet transmission or electronic storage is completely secure and that ph433 cannot guarantee absolute security of your data. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

9. Limitation of Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, PH433 SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

ph433 does not warrant that Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. ph433 does not warrant that any errors or defects will be corrected or that game outcomes will meet your expectations. ph433 expressly disclaims all liability for any losses, damages, or negative consequences arising from your use of or inability to use Services, including but not limited to losses from gambling activities, technical failures, unauthorized access to your account, or reliance on information provided through Services.

IN NO EVENT SHALL PH433, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PH433 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To the extent permitted by applicable law, ph433's total aggregate liability to you for all claims arising from or related to these Terms or your use of Services shall not exceed the lesser of: (a) the total amount deposited into your ph433 account during the six (6) months immediately preceding the claim; or (b) ten thousand Philippine Pesos (PHP 10,000). Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

10. Account Suspension, Termination, and Closure

ph433 reserves the right to suspend, restrict, or terminate your account and refuse current or future use of Services at any time and for any reason, including but not limited to: violation of these Terms; fraudulent, suspicious, or illegal activity; failure to provide required verification documentation; chargebacks or payment disputes; abusive behavior toward ph433 staff or other players; or failure to meet eligibility requirements.

Upon account termination, your license to use ph433 Services immediately ceases. ph433 will process withdrawal of any remaining legitimate balance after deduction of applicable fees, outstanding debts, or amounts attributable to Terms violations. However, ph433 reserves the right to retain funds where account closure results from fraud, bonus abuse, money laundering, or other serious violations. In such cases, ph433 may report violations to appropriate authorities and cooperate with law enforcement investigations.

You may request voluntary account closure at any time by contacting ph433 customer support. Voluntary closures for responsible gaming purposes (self-exclusion) are subject to cooling-off periods during which accounts cannot be reopened, and ph433 will make reasonable efforts to prevent you from creating new accounts during exclusion periods. Account closures do not relieve you of any outstanding obligations under these Terms.

11. Modification of Terms

ph433 reserves the right to modify, amend, or update these Terms at any time in its sole discretion. Material changes will be communicated to registered users via email, notification upon login, or prominent posting on the ph433 website at least thirty (30) days prior to the effective date of changes, except where immediate modification is required by regulatory directive, legal requirement, or to address security vulnerabilities.

Your continued use of ph433 Services following the effective date of modified Terms constitutes your acceptance of such changes. If you do not agree to modified Terms, your sole remedy is to discontinue use of Services and close your account. It is your responsibility to review Terms periodically to remain informed of updates. The "Last Updated" date at the top of this document indicates when Terms were most recently revised.

12. Indemnification

You agree to indemnify, defend, and hold harmless ph433, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to: (a) your violation of these Terms; (b) your violation of any law or regulation; (c) your violation of any rights of third parties; (d) your use or misuse of ph433 Services; (e) your provision of inaccurate, misleading, or fraudulent information to ph433; or (f) your willful misconduct or negligence.

This indemnification obligation survives termination of your account and your use of ph433 Services. ph433 reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with ph433's defense of such claims.

13. Governing Law and Jurisdiction

These Terms and your use of ph433 Services shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or ph433 Services shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines, and you irrevocably consent to personal jurisdiction and venue in such courts.

The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

14. Dispute Resolution and Arbitration

Any controversy, dispute, or claim arising out of or relating to these Terms or your use of ph433 Services shall first be submitted to informal resolution through direct negotiation with ph433 customer support. If informal resolution does not resolve the dispute within thirty (30) days, either party may initiate binding arbitration administered by the Philippine Dispute Resolution Center, Inc. (PDRCI) in accordance with its arbitration rules then in effect.

Arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties, or if agreement cannot be reached, appointed by PDRCI. The arbitration shall take place in Metro Manila, Philippines, and shall be conducted in English. The arbitrator's decision shall be final and binding on both parties, and judgment on the award may be entered in any court having jurisdiction. Each party shall bear its own costs of arbitration, including attorney fees, unless the arbitrator determines that one party is the prevailing party entitled to recover costs.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO HAVE DISPUTES HEARD BY A JUDGE OR JURY AND YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATIONS. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, Responsible Gaming Policy, and any additional terms for specific Promotions or Services, constitute the entire agreement between you and ph433 concerning your use of Services and supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to Services.

15.2 Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without ph433's prior written consent. ph433 may freely assign these Terms and any rights or obligations hereunder to any affiliated entity or successor in connection with a merger, acquisition, corporate reorganization, or sale of assets.

15.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. ph433's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4 Force Majeure

ph433 shall not be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
